There are five classifications for felony crimes in the state of Texas. These include:

  • State Jail Felony – DWI offenses are often charged as state jail felonies. The penalties can carry 6 – 24 months in jail and up to $10,000 in fines.
  • Third Degree Felony – These felonies carry a prison sentence from 2 – 10 years and up to $10,000 in fines.
